General Conditions
These General Conditions apply to every order placed and every purchase made at a KFC Aruba restaurant, by telephone, or through any KFC Aruba channel.
Last updated: 7 August 2026 · Version 1.0
1. Definitions
- KFC Aruba: KFC Aruba Restaurants VBA, operator of the KFC restaurants in Aruba, head office at Caya Ernesto Petronia 62, Aruba, phone +297 280 1110, email info@kfc.aw.
- Customer: any natural or legal person who places an order with KFC Aruba.
- Order: a request by the customer for products from our menu.
- Agreement: the agreement between KFC Aruba and the customer regarding an order.
2. Applicability
These General Conditions apply to all offers, orders and agreements of KFC Aruba. Deviating conditions apply only if we have accepted them in writing. Conditions of the customer are expressly rejected.
3. Offers and prices
- Menus, prices and promotions published in restaurant, online or in advertising are indicative and can be changed at any time.
- Prices are quoted in Aruban Florin (AWG) and include applicable turnover tax and levies unless stated otherwise.
- Obvious errors and printing mistakes do not bind KFC Aruba.
- Availability of products can differ per restaurant and per time of day.
4. Formation of the agreement
An agreement is formed when KFC Aruba accepts the order at the counter, at the drive-thru or by telephone. KFC Aruba may refuse an order, for example when a product is unavailable, when an order is unreasonably large, or in case of suspected misuse or unlawful behaviour.
5. Payment
- Payment is due at the moment of purchase, in cash (AWG or USD at the applicable in-store rate) or by the payment cards accepted in the restaurant.
- Telephone orders are paid on collection.
- Please check your receipt and change before leaving the counter.
6. Collection, drive-thru and delivery
Preparation and waiting times communicated by us are estimates and are never fatal deadlines. Where delivery is offered through a third-party delivery partner, the conditions of that partner apply to the delivery itself; KFC Aruba remains responsible for the food it prepares.
7. Cancellation and refunds
Our products are freshly prepared perishable food made to order. For that reason, orders cannot be cancelled or returned once preparation has started, and the statutory right of withdrawal for distance selling does not apply to freshly prepared food. If a product is incorrect, incomplete or not of the quality you may expect, contact the restaurant as soon as possible — we will replace the product or refund it.
8. Promotions, coupons and gift cards
- Promotions are valid for the stated period, at participating restaurants, while stocks last.
- Promotions and coupons cannot be combined with other offers unless expressly stated.
- Coupons, vouchers and gift cards cannot be exchanged for cash and are not replaced if lost, stolen or damaged.
- KFC Aruba may end or amend a promotion at any time in case of abuse, fraud or error.
9. Food safety and allergens
Our kitchens handle allergens including gluten, milk, egg, soy, mustard, celery, sesame and nuts, and shared fryers and equipment are used. We therefore cannot guarantee that any product is free from a specific allergen. Customers with an allergy or intolerance must inform a team member before ordering. Food is intended for immediate consumption; once it leaves the restaurant, proper storage and handling is the customer's responsibility.
10. Complaints
Complaints should be reported as soon as reasonably possible, and in any case within 7 days, to the restaurant concerned or by email to info@kfc.aw or by phone on +297 280 1110, stating the restaurant, date, time and receipt number. We aim to respond within 14 days. Postal address: KFC Aruba Restaurants VBA, Caya Ernesto Petronia 62, Aruba.
11. Liability
KFC Aruba's liability is limited to direct damage and, per event, to no more than the invoice value of the relevant order, unless the damage is the result of intent or gross negligence on our part or mandatory (product) liability law provides otherwise. KFC Aruba is not liable for indirect or consequential damage.
12. Force majeure
KFC Aruba is not obliged to perform if prevented by circumstances beyond its control, including supply failures, power or system outages, strikes, extreme weather, hurricanes, government measures or pandemics.
13. Conduct in our restaurants
Our restaurants are private property. We may refuse service or ask a person to leave in case of aggressive, discriminatory, intoxicated or otherwise disruptive behaviour. Camera surveillance may be used for the safety of guests and staff; see our Privacy Policy.
14. Personal data
Personal data is processed in accordance with our Privacy Policy.
15. Amendments, applicable law and disputes
KFC Aruba may amend these General Conditions; the version applicable at the moment of the order governs the agreement. Aruban law applies. Disputes are submitted to the competent court in Aruba, unless mandatory consumer law provides otherwise.
